What personal information do we collect about you?

We collect personal information from you when you provide it to us directly and through your use of the site. This information may include:

  • Information you provide in addition when completing a transaction on the site, for example details of your driving licence;

This privacy statement is primarily aimed at users of the site. However, if you are applying for a job with CARLUV, we will collect and use the information you provide to us in the course of your application to assess your suitability for the position you have applied for and for other roles in the future, and to monitor diversity and equal opportunities in our recruitment process. What do we use this personal information for?

Depending on how you use the site, your interactions with us, and the permissions you give us, the purposes for which we use your personal information include:

Credit checks and driving licence verification

If you are obtaining financing from a Third-Party Provider via our site, the information you provide may be used to run a credit check. The results of this check may affect whether or not you can complete the transaction on the site.

In order to buy a car from us, you must confirm that you hold a valid driving licence. Before completing the transaction, we will use a third party to confirm that your driving licence is valid. As part of this check, we will receive information about any driving convictions you have.

Our basis for processing under UK data protection law

We are required to have a lawful basis under UK data protection law to process your personal information. Other than in exceptional circumstances, our lawful basis for processing is:

Contract: To perform a contract with you (if you’re buying a car from us), or take steps at your request before you enter into a contract with us (in other words, before you make the purchase).

Consent: We rely on your consent to process your personal information when you transact with us, or otherwise voluntarily provide us with information. We may also ask your consent to send you marketing, and to set non-essential cookies on your device. We will seek your explicit consent to process information about any driving convictions.

You can withdraw your consent at any time, for example by opting-out of receiving marketing communications or deleting your cookies.

Legitimate interests: We will also process your personal information where it is in CARLUV or a third party’s legitimate interests to do so, in order to maintain our site and conduct our business. For example:

  • We conduct an analysis on our user base and the searches made via our site;
  • We may contact you after you have used our site to ask if you have transacted with a Third-Party Provider (so that we can collect commission from the relevant person, and for our own internal research purposes);

Where is your personal information stored?

Our site is hosted by Amazon Web Services which has servers based around the world, and we may use other international service providers. Consequently, your personal information will be processed in countries outside of Europe, including in countries where you have fewer legal rights in respect of your data than you do under local law. Where we transfer personal information outside the European Economic Area we will, as required by applicable law, ensure that your privacy rights are adequately protected by appropriate safeguards, including by using the EU Standard Contractual Clauses and the EU-US Privacy Shield. How long do we keep your personal information?

We keep a record of transactions on our site for up to seven years, to protect us from legal claims.

Please note, however, that if you unsubscribe from our marketing communications, we will keep a record of your email address to ensure we do not send you marketing emails in future.
